Respondents Habeas Corpus Petition has been filed under Article 226 of the Constitution of India for a Writ of Habeas Corpus, directing the 1st respondent to produce the body of the detenue, namely, Bhavani, D/o.Madhanagopal, aged about 21 years, before this Court forthwith and to set her at liberty.

O R D E R

(Order of the Court was made by M.JAICHANDREN,J) This Habeas Corpus Petition has been filed, by the father of the detenue, praying that this Court may be pleased to issue a Writ of Habeas Corpus, to direct the 1st respondent to produce his daughter, namely, Bhavani, aged about 21 years, before this Court, and to set her at liberty.

2. The petitioner is the father of the detenue. He has stated that, his daughter, namely, Bhavani, who was studying in B.Sc. (Zoology) at Quaid-e-Milleth College of Arts and Science, Chennai, has been found missing, since, 26.03.2016. The petitioner has stated that the 2nd respondent has abducted her and he is keeping her in illegal custody. Therefore, he had lodged a complaint before the 1st respondent police, on 27.03.2016. The said complaint had been issued with C.S.R.No.131/2016. However, as no effective steps have been https://hcservices.ecourts.gov.in/hcservices/

taken by the 1st respondent police, to trace the detenue, based on the complaint given by the petitioner, he has preferred the present Habeas Corpus Petition, before this Court.

Mr.V.M.R.Rajentren, the learned Additional Public Prosecutor appearing on behalf of the 1st respondent, had submitted, on instructions, that the detenue has eloped with the 2nd respondent, therefore, the father of the 2nd respondent has preferred a complaint before the, K-9, Thiru-Vi-Ka Nagar Police Station, Chennai, in connection with which a case, in Crime No.260 of 2016, for ''Man Missing'' has been registered. 4.

In such circumstances, we find it appropriate to close the Habeas Corpus Petition, as no further orders are necessary, at this stage. Hence, the Habeas Corpus Petition is closed. However, the 1st respondent shall continue the investigation and trace the missing detenue and to take necessary steps in accordance with law.
