The petitioner/A1, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 294(b), 352, 354(A) and 506(ii) of I.P.C, in Crime No.299 of 2023 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 12.04.2023, while the defacto complainant along with his wife were travelling in the bus, at that time, the accused had teased the wife of the defacto complainant and abused her in a filthy language, assaulted her with hands and also threatened the defacto complainant with dire consequences. Hence the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that this is the second application for anticipatory bail and the earlier anticipatory bail application was dismissed by the learned Principal District and Session Judge, Thiruvannamalai, in Crl.M.P.No.2055 of 2023 on 30.06.2023. He also submitted that the petitioner is ready to abide 1/4

by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4.Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the accused have teased the wife of the defacto complainant, while she was travelling in a bus along with her husband and abused her in a filthy language, assaulted her with hands and also threatened them. He also submitted that the investigation is still pending. Hence, he opposed for grant of bail to the petitioner. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.

6.After hearing the learned Government Advocate (Crl.Side), I found that the petitioner has teased the wife of the defacto complainant and also made a criminal intimidation on the wife of the defacto complainant and the public were solved the issue. Thereafter, the accused, by taking vengeance for the same, followed the defacto complainant and threatened him. 2/4

7.Taking into consideration the nature and gravity of the offence and the attitude of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
