JUDGMENT

Challenge has been made to the decree and judgment passed in counter claim directing the plaintiffs to pay a sum of Rs.9,81,708/- to the defendant with interest at the rate of 12% per annum from the date of suit till the date of decree and subsequently, at the rate of interest at 6% p.a. till the date of realization, in the present Appeal Suit.

2. When the matter is taken up today, the learned counsel appearing for the respondent has filed a Joint Memo dated 21.03.2025 before this Court. The learned counsel appearing for both sides submitted that the matter has been amicably settled between the parties and Joint Memo has been filed stating that the respondent is delivering a demand draft No.020385 dated 19.03.2025 for a sum of Rs.10,00,000/- [Rupees ten lakhs only]. filed by the respondent is recorded. The learned counsel appearing for the appellants submitted that the Court fee may be refunded in the name of the third appellant.

3. Accordingly, this Appeal Suit is dismissed as settled out of Court. No costs. The registry is directed to refund the Court Fee in favour of the third appellant as per law. The Joint Memo filed by the respondent shall form part of the decree. Consequently, connected miscellaneous petition is closed. No costs.
