PRAYER: The Second Appeal has been filed under Section 100 of C.P.C. against the Judgment and Decree of the Sub Court, Dharapuram, made in A.S.No.24 of 1997 dated 30.06.1999 confirming the Judgment and decree of the District Munsif Court, Kangayam, made in O.S.No.104 of 1996 dated 19.03.1997. For Appellant :No Appearance For Respondents :R1 to R4 - No Appearance Not ready on notice - Reg. R5

J U D G M E N T

Earlier when the matter was taken up for hearing on 25.03.2010, it was represented by the learned counsel for the appellant that he had handed over the brief to the party. Hence, this Court had directed the Registry to issue notice to the Appellant. The said notice returned with an endorsement 'Addressee expired'.

2.Though the name of the appellant is printed in the cause list, no one represented the Appellant.

The Legal Representatives of the Appellant also have not taken any steps to implead themselves in the appeal for prosecuting the appeal. 3.In view of the above, the second appeal is dismissed as abated. No costs.
