Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the 3rd respondent to dispose of the representation of the petitioner dated 27.05.2025 seeking for field measurement of the roads forming a "U" shape specifically the 0.161⁄2 cent road portion situated in SF No.142, A.Sangampalayam Revenue Village, Pollachi Taluk, Coimbatore District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The petitioner seeks issuance of a direction for a measurement to be carried out on the claim that the subject land is being used by the petitioner as road and therefore, appropriate action should be

taken against the respondents to convert the same as a public way.

2. On petitioner's own declaration, a civil suit filed by the petitioner is pending. The aforesaid civil suit, according to petitioner's own declaration, seeks a decree for protection of easementary right.

3. In view of the pendency of the suit, in our view, this petition is misconceived. Petition is dismissed. There shall be no order as to costs.

Before parting with the case, we must hasten to add that we have not expressed any opinion on the petitioner's claim in the suit, which shall be decided on its own merits without being influenced by the order passed by this Court.
