Prayer:- Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus directing the first and second respondents to extend the pay scale of Rs.5200-20200+1900 to the petitioners with effect from 01.01.2006 notionally and monetarily from 01.08.2010 as per G.O.Ms.No.338 Finance [Pay Cell] Department dated 26.08.2010 as done to the other co-employees of various Town Panchayats of Tamil Nadu particularly Edangannasalai Town Panchayat, Salem and Thakkolam Town Panchayat Vellore District and consequently direct the first and second respondents to pay the eligible arrears of pay accumulated on account of such pay re-fixation to the petitioners with reasonable interest for causing abnormal delay. ORDER

This Writ Petition has been filed to direct the first and second respondents to extend the pay scale of Rs.5200-20200+1900 to the petitioners with effect from 01.01.2006 notionally and monetarily from 2/5

01.08.2010 as per G.O.Ms.No.338 Finance [Pay Cell] Department dated 26.08.2010 as done to the other co-employees of various Town Panchayats of Tamil Nadu particularly Edangannasalai Town Panchayat, Salem and Thakkolam Town Panchayat Vellore District and consequently direct the first and second respondents to pay the eligible arrears of pay accumulated on account of such pay re-fixation to the petitioners with reasonable interest for causing abnormal delay.

3. The grievance of the writ petitioner is that G.O.Ms.No.338 Finance [Pay Cell] Department dated 26.08.2010 has been passed on the basis of the One Man Commission recommendation. However, the same has not been implemented to the petitioners. In this regard, the petitioners have given a representation to the respondents on 09.06.2023. But the same has not been considered by the respondents. Hence, the present Writ Petition has been filed.

4. In such view of the matter, this Court directs the second respondent to consider the representation of the petitioners dated 3/5

09.06.2023 in terms of the G.O.Ms.No.338 Finance [Pay Cell] Department dated 26.08.2010 and pass Orders on merits within a period of two months from the date of receipt of a copy of this Order.
