Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Section 174 of Cr.P.C altered into Section 305 of IPC in Crime No.360 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner's son and the deceased/de-facto complainant's daughter had love affair and later, the accused A1/petitioner's son and the petitioner herein refused for the marriage. Hence, she committed suicide by hanging herself in her home. Hence, the law enforcing agency registered case against the petitioner and other accused person based on the complaint lodged by the de-facto complainant. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that his son and the deceased loved each other and the petitioner arranged the marriage for his son and the deceased, but the same was not accepted by the deceased family, therefore, she committed suicide. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate submitted that the petitioner's son and deceased had love affair and the same was objected by the petitioner. Hence, the de-facto complainant's daughter committed suicide by hanging herself. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and the allegation level against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner as one girl lost her life.
