Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st respondent to dispose of the Statutory Appeal filed by the petitioner in Appeal No. 10027958/G/2025 dated 04.04.2025 within a time stipulated by this honourable Court. ORDER
This writ petition has been filed for the issuance of a Writ of Mandamus directing the first respondent to dispose of the statutory appeal filed by the petitioner under the Chit Funds Act against the order passed by the Arbitrator in ARC No.615 of 2012 dated 28.12.2020.
2. Heard Mr.D.G.Hariprasath, learned counsel for the petitioner, Mr.E.Veda Bagath Singh, learned Special Government Pleader for the first respondent and Mr.L.J.Vengatesh, learned Central Government Standing Counsel for the respondents 2 and 3.
3. The grievance expressed by the petitioner is that as against the order passed by the Arbitrator in ARC No.615 of 2012 dated 28.01.2020, the petitioner 2/5
has preferred a statutory appeal filed before the first respondent and the same is pending. In the meantime, steps were taken to attach the property of the petitioner and aggrieved by the same, the present writ petition has been filed.
4. Taking into consideration the facts and circumstances of the case and considering the fact that the statutory appeal filed by the petitioner under Section 70 of the Chit Funds Act 1982 is pending before the first respondent, there shall be a direction to the first respondent to deal with the appeal and pass final orders within a period of eight weeks from the date of receipt of a copy of this order. In the meantime, the execution of the order passed by the Arbitrator in ARC 615 of 2012 shall be kept in abeyance.
