That this Hon'ble Court may be pleased to pass and order and decree in
favour of the Plaintiff and against the Defendant Vessel (MT) INTAN T3501 having IMO Number 9424338 and her owners and all persons interested in her towards causing loss of Rs.1,66,66,666/- together with further interest at the rate of 18% Per Annum from date of suit till its realization as per particulars of Claim.
b. That the Defendant (MT) INTAN T3501 having IMO No. 9424338 together with her hull, tackle, engines, Machinery, Boats, bunkers, equipment, paraphernalia, and all other appurtenances presently lying at Port of Tuticorin within the territorial waters of India be arrested by a warrant of arrest of this Hon'ble Court and the same be condemned in respect of the claim herein an ordered to be sold along with the hull, tackle, engines, Machinery, Boats, bunkers, equipment, paraphernalia and the net sale proceeds thereof be ordered to be applied to the satisfaction of the Plaintiffs claim herein. c. For cost of this Suit; and d. For such further or other reliefs as this Hon'ble Court may deem fit and proper in the nature and circumstances of the case. For Plaintiff(s):

JUDGMENT
In the light of the order passed in Application No.5196 of 2024 dated 03.03.2025 and the order passed in application No.4720 of 2025 dated 29.01.2026 nothing survives in this Suit, since the arbitral proceedings has
resulted in a partial final award dated 05.03.2025 wherein the defendant now has a claim of nearly Rs.2.5 crores against the plaintiff and it far exceeds the amount that was sought to be recovered by the plaintiff against the defendant to the tune of Rs.1,66,66,666/- along with interest. Accordingly, the Suit is also closed. There shall be no order as to costs. Consequently, the connected applications are closed.
