The Transfer Civil Miscellaneous Petition has been filed by the petitioner / wife seeking transfer of petition for divorce filed by the respondent / husband in IDOP No.39 of 2025 pending on the file of Principal District Judge, Salem to Principal District Judge, Dharmapuri.

Heard the arguments of learned counsel on either side. 3.
According to petitioner, she is residing at Bommidi within the jurisdiction limits of District Court, Dharmapuri and she is having two years old child. She expressed difficulty in undertaking long travel from Salem to Dharmapuri, which is 85 kms away from her residence.

Though the respondent is served and name printed in the cause list, there is no appearance.

It is settled law that in cases of matrimonial dispute, the preference shall be given to the convenience of wife. 6.
In the case on hand, the petitioner / wife is residing at Bommidi, within the territorial limits of Court at Dharmapuri and she is having two years old child. In such circumstances, it may not be possible for her to undertake such a long travel for the purpose of attending the court hearings. Hence, taking into consideration the convenience of petitioner / wife, this Court is inclined to transfer the above transfer petition as prayed for.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed and I.D.O.P.No. 39 of 2025 pending on the file of the Principal District Judge, Salem is withdrawn and transferred to the file of the Principal District Judge, Dharmapuri.
