ORDER

The writ petition has been filed by the petitioner seeking for Mandamus to direct the 2nd Respondent to withdraw the order of oral dismissal on 30.04.2002 and thereon reinstate the petitioner to the post of Lab Assistant considering the representations made by the petitioner on 04.02.2003 and 09.06.2003 and finally on 07.10.2003 to absorb the petitioner to the said post of Laboratory Assistant or such other similar post falling vacant in the 1st respondent University.

Though the Petitioner has given representations dated 04.02.2003, 09.06.2003 and 07.10.2003 respectively and the same are pending without passing any orders by the first respondent/Madurai Kamaraj University, the petitioner has prayed this Court seeking direction to the 1st Respondent to pass orders on the representation dated 07.10.2003.

3. I heard the submissions of Mr.K.Venkateswaran, learned counsel appearing for the petitioner and Mr.S.Sethuraman, learned counsel appearing for the respondents.

4. This Court, without going into the merits of the case, I am inclined to direct the petitioner to give fresh representation to the first respondent within a period of 15 days from the date of receipt of a copy of this order and on receipt of such representation being made, the first respondent is directed to consider and dispose of the same, by giving personal opportunity to the petitioner and to pass orders, on merits and in accordance with law, within a period of twelve weeks thereafter.
