Crl.O.P.No.17633 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Vijayakumar @ Viji, who was arrested and remanded to judicial custody on 28.05.2023 for the offences punishable under Sections 294(b), 324, 307, 506(ii) of IPC in Crime No.225 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 28.05.2023. Thus, he seeks bail to the petitioner.

The learned Additional Public Prosecutor submitted that, on 12.04.2023 at about 10.00.p.m., defacto complainant's husband along with his friends namely Vijayakumar and Sivakumar were proceeding in an auto to a tasmac shop near Vadapazhani Ganagaiamman Temple at Tondiarpet. Sivakumar and Vijayakumar were fighting in connection with money dispute. Defacto complainant's husband asked as to why they were fighting. Then at about 01.45.a.m., auto driver stopped the auto near Gangaiamman Temple. Then, Vijayakumar had attacked the defacto complainant's husband with a knife on his head stating that, why 1/3

he has reprimanded him. As a result, defacto complainant's husband suffered serious injuries. He further submitted that, apart from this case, there are 13 previous cases pending against the petitioner, including a murder case.

4. The perusal of the accident register of the defacto complainant's husband Muthuvel, it shows that, he suffered left frontal bone fracture.

5. Considering the gravity of the offence committed by the petitioner and the fact that, apart from this case, there are 13 previous cases pending against the petitioner and also having regard to the fact that, investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original petition is dismissed. 07.08.2023 Sma 2/3
