ORDER
This Criminal Original Petition has been filed seeking transfer of investigation in Cr.No.78 of 2025 pending on the file of the third respondent to the file of the second respondent.
According to learned counsel for the petitioner the investigating officer has not taken effective steps to find out the whereabouts of the petitioner's wife and daughter, who went out on 14.05.2025 and there is no proper explanation from the investigating officer about the progress of the investigation. Therefore the petitioner seeks transfer of investigation. Learned Government Advocate (Crl.Side) for the respondents would submit that the preliminary investigation would reveal that the petitioner's wife eloped with one Dhanush, who is a distant relative, along with the child, due to illegal intimacy. It is seen that the grievance of the petitioner is that his wife along with their child were missing from 14.05.2025 and it is not the case of the petitioner that they were abducted by someone and the petitioner has not even named any accused. Primary investigation also reveal that she 2/4
eloped with a distant relative. Therefore there is no valid reason to transfer the investigation.
Accordingly, this Criminal Original Petition stands dismissed. However, the respondent police is directed to expedite the investigation and file charge sheet within a period of three months from the date of receipt of a copy of this order.
