Defendant PRAYER: Plaint filed under Order IV Rule 1 of the Original Side Rules read with Order VII Rule 1 of Civil Procedure Code praying for the judgment and decree against the defendant as follows:
(i) Directing the defendant to perform the Sale Agreement dated 10.08.2016 and to do all such acts, deeds and things as may be necessary to execute sale deed for the property bearing Old Door No.9, then No.16, Now No.68, Maddox Street, Choolai - 600 112, more particularly said out in the schedule hereunder by deed of conveyance in favour of Plaintiff by sale deeds, after receiving the balance sale consideration of Rs.85,00,000/- (Rupees Eighty Five Lakhs Only) the cost of which shall be borne by the plaintiff within a time fixed by this Court failing which to direct the officer of the Hon'ble Court to execute the Sale Deed in respect of Suit schedule property may be executed through the officer of this Court; 1/3
(ii) For permanent injunction restraining the defendant, her men, agents, servants or anybody else claiming through her from in any manner dealing with the suit property either by way of alienate or encumber in any manner;
(iii) To pay cost of the suit.

Learned counsel for the plaintiffs filed a Memo dated 05.10.2023 signed by the plaintiffs stating that the matter has been settled out of court and seeks permission of this Court to withdraw the Civil Suit. 2.The Memo dated 05.10.2023 filed by the plaintiffs is taken on file and the Civil Suit is dismissed as settled out of Court. No costs. Consequently, connected Original Application is closed. 3.Registry is directed to return the Court Fee, as per rules. 05.10.2023 TK 2/3
