ORDER
This Criminal Original Petition is filed with a prayer to grant Police Protection.
2. Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the gist of the grievance is that when the petitioner purchased the property from the 3rd respondent, being the vendor, the vendor himself is trying to interfere with the possession and enjoyment of the property after executing the sale deed and putting the petitioner into possession.
3. When the petitioner has lodged a complaint, no action has been taken. Considering the nature of grievance expressed by the petitioner with reference to the possession of the property, the Police will not be in a position to determine as to who is in lawful possession.
4. It will be open for the petitioner, to file a civil suit and as and when any interim order is granted in favour of the petitioner, thereafter, as per the terms of the interim order, the second respondent Police is directed to render the Police Protection to the petitioner to enjoy the property as per the order of the Civil Court.
