O R D E R

This petition has been filed to transfer the case in Crime No.264 of 2023 on the file of the 4th respondent police station to any other police District Police Station and further direct to investigate and file a final report within the time stipulated.

2. Based on the complaint filed by the petitioner, F.I.R. has been registered in Crime No.264 of 2023 for offences punishable under Sections 403, 406, and 420 of the IPC and Section 75 of the Chit Funds Act against the accused. During the course of the investigation, several persons were examined and their statements were recorded.

3. Pending the investigation, the accused transferred a sum of Rs.7,50,000/- to the petitioner and assured that the balance amount would be transferred to the complainant. Therefore, the investigation is still pending and final report has not yet been filed. However, the accused has not complied with the undertaking and the charge sheet will be filed within a stipulated time.

4. In view of the above, the transfer of the investigation is not possible, as the 4th respondent has already completed the investigation and is about to file the final report.

5. With the above observations, the Criminal Original Petition is dismissed. The 4th respondent is directed to complete the investigation and file the final report within 12 weeks from the date of receipt of a copy of this order. 04.02.2025 Index : Yes/No : Yes/No Speaking/non-speaking order To,
