The petitioner has come up with this Writ Petition challenging the tender/auction notification published in Madurai District Gazette, dated 26.02.2004 and the consequential notification published in the Tamil Newspaper Thinathanthi, dated 15.04.2004 issued by the respondent, insofar it relates to Item O.Grass Plot No.2 (39.50 acres) Plot No.3 (23.37 acres) in the said Notification and for a consequential direction to the respondent to conduct the auction proceedings alone in conformity with the rules framed under the District Municipalities Act.

Today, when the matter is taken up for hearing, learned counsel for the petitioner submitted that he has no instructions from the petitioner. However, he submitted that the tender period is already over and that nothing further survives for consideration in this matter.

Recording the said submission of the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous.

No costs. Consequently, connected W.P.M.P.No.13900 of 2004 is closed.
