This petition is filed under Section 378 Cr.P.C, to grant leave to the petitioner to file a criminal appeal against the order of acquittal passed by the Metropolitan Magistrate, Fast Track Court No.I, Egmore @ Allikulam, Chennai in C.C.No.1959/2021 dated 27.01.2023.

2. Heard Mr.M.Kempraj, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the complainant was present on all the hearing dates the trial Court had dismissed the petition on the ground that the complainant was absent. According to him, there are arguable points in the main appeal and therefore, leave is granted as prayed for.
