Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 31.10.2018 and provide employment to the petitioner on compassionate ground upon the death of her husband, C.Jeevarathinam.

O R D E R

This writ petition has been filed seeking issuance of writ of mandamus directing the respondents to consider the representation of the petitioner dated 31.10.2018, wherein and whereby she sought for employment on compassionate ground due to the death of her husband, viz., C.Jeevarathinam.

2. It is stated that the petitioner's husband viz., C.Jeevarathinam, was employed as a Sanitary Worker in the Avadi Municipality, Avadi, Chennai-600 054 and he died on 01.08.2017, while he was in service. It is further stated that though the https://hcservices.ecourts.gov.in/hcservices/

petitioner made an application to the respondents seeking employment on compassionate ground, the same has not been considered and hence, she made a representation to the respondents on 08.07.2019.

3. Since the application given by the petitioner to the respondents is well within three years, respondents are directed to consider the case of the petitioner, if she is otherwise eligible to be accommodated as Class-IV employee. If there are any other candidates in the queue seeking appointment on compassionate ground, the name of the petitioner shall be included in the said seniority list and he cannot claim priority over them.

4. With the above observation, this Writ Petition is disposed of. No costs.
