Respondents Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to open the tender submitted by the Petitioner along with the respondent 4 to 6, in respect of Tender Notification No:C4/5776/2021 dated on 23.09.2021 issued by the 3rd Respondent and published in Dinakaran Trichy Edition on 23.09.2021 for the Transportation of Carrier Based Bio-fertilizer and Liquid Biofertilizer to the various agricultural extension centres throughout Tamilnadu.

When the matter is taken up for hearing, the learned counsel appearing for the respondents 1 to 3 submitted that during the pendency of the writ petition, the tender in respect of Tender Notification No:C4/ 5776/ 2021 dated 23.09.2021 issued by the 3rd Respondent for the Transportation of Carrier Based Biofertilizer and Liquid Bio-fertilizer to the various agricultural extension centres throughout Tamilnadu was opened on 01.10.2021 and the same was awarded in favour of the 5th respondent. Hence, the prayer sought for by the petitioner becomes infructuous.

2. Recording the said submission made by the learned counsel for the respondents 1 to 3, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed. However, liberty is granted to the petitioner to workout his remedy in the manner known to law.
