ORDER

This Criminal Original Petition is filed with a prayer not to harass the petitioner.

2. When the matter is taken up for hearing, the learned Counsel for Government of Tamil Nadu (Crl. Side) would submit that one Lakshmi has given a complaint against the petitioner and enquiry is pending. The petitioner has also given a counter complaint. Only to conduct the preliminary enquiry with reference to both complaints, the petitioner's presence is necessary.

3. In reply thereof, the learned counsel for the petitioner would submit that already one round of preliminary enquiry is conducted and now merely because one more petition is forwarded from the Commissioners' Office, the petitioner is again called. This apart, the petitioner has also suffered a stroke yesterday and he is now hospitalised.

4. In view of the above submissions, this Criminal Original Petition is disposed of on the following terms:

i. the respondent Police shall require the presence of the petitioner for the enquiry into the complaint of the petitioner and also against the petitioner by issuing a summon;

ii. on the particular day, the petitioner can appear and even if he is unable to appear on being hospitalised, the said information shall be passed on to the Investigating Officer;

iii. The Investigating Officer shall thereafter enquire the petitioner and complete the enquiry on the same day or in another one or two working days and complete the enquiry.
