PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider and pass orders on the petitioner's representation on 13.07.2023 as per the provisions at the Street Vendors (Protection of livelihood Regulation )Act, 2014, made for granting permission/certificate of vending and till such time not to disturb with the running of the petitioner's bunk shop at Running Bunk At Dhayasadan Left Side Compound Gate, Konnur High Road, Otteri, Nammalwerpet, Chennai-600 012 wherein selling juice, tea, coffee and other food items by using LPG gas stove.

The petitioner herein seeks a directions to respondents to consider his representation dated 13.07.2023 and pass necessary orders permitting the petitioner to run bunk shop at Dhayasadan Left Side Compound Gate, Konnur High Road, Otteri, Nammalwerpet, Chennai-600 012

2. It is the case of the petitioner that he is a differently abled person having 50 % disability and he is running a bunk shop in the above mentioned place. The petitioner is engaged in selling of tea, coffee and other food items. It is the specific case of the petitioner that he is leading his livelihood only by running the above said bunk shop and the same is not disturbing the general public in the above mentioned place. The petitioner submitted a representation on 13.07.2023 requesting the respondent permitting to run the bunk shop in the above mentioned place.

3. Mr.A.S.Ragul Adhithya, learned counsel for Mrs.P.T.Ramadevi, learned Standing Counsel (GCC) for the respondents on instructions submits that the respondents received representation of the petitioner only on 17.07.2023 and the same will be disposed of in due course.

In view of the limited prayer made by the petitioner, without expressing any opinion on the claim made by the petitioner, this Court is inclined to issue a direction to the 1st respondent to consider a representation of the petitioner dated 13.07.2023 and pass final orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
