ORDER

This Criminal Original Petition has been filed, seeking a direction to the learned Principal District and Sessions Judge, Ariyalur (Special Court for SC/ST cases), Ariyalur to consider bail application of the petitioners herein on the same day of their surrender in Crime No. 308 of 2026 pending on the file of the respondent police.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 and also perused the materials available on record.

3. The case of the prosecution is that the de facto complainant is residing near Panchayat water tank. The Panchayat President had instructed the de facto complainant to switch on the motor pump twice a day and thereafter remove the fuse carrier to prevent excessive usage of motor pump. It is alleged that on 29.05.2026, the named accused persons operated the pump throughout the night. On the next day, when the de facto complainant's mother had questioned the same, she was abused using caste name. When the de facto complainant

intervened, both the de facto complainant and his mother were allegedly assaulted by the accused.

4. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case.

5. In view of the above factual position, there shall be a direction to the learned Principal District and Sessions Judge, Ariyalur (Special Court for SC/ST cases), Ariyalur to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No. 308 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
