records relating to the impugned proceedings of the 3rd Respondent in Na.Ka.No.641/2026/A1 dated 19.05.2026 and quash the same as being without jurisdiction, illegal and arbitrary insofar as it seeks to enquire into or adjudicate the title, ownership, administration and management of the Vinayagar Temple and the adjoining properties of Arulmigu Subramania Swamy Temple and consequently, forbear the Respondents from conducting any enquiry or passing any orders relating to the title, ownership, administration or management of the said temple properties.

ORDER

This Writ Petition has been filed by the Petitioner praying to quash the impugned proceedings dated 19.05.2026 bearing Na.Ka.No.641/2026/A1 issued by the 3rd Respondent and consequently, forbear the Respondents from conducting any enquiry or passing any orders relating to the title, ownership, administration or management of the Vinayagar Temple and the adjoining properties of Arulmigu Subramania Swamy Temple.

2. The learned Government Advocate appearing on behalf of the Respondents submitted that the Vinayagar Temple is situated in a Natham land and there have been disputes over the management/ownership of the said Temple.

2.1. It is also submitted by the learned Government Advocate for the Respondents that as there are conflicting claims between the Petitioner and one Mr.Purushothaman regarding the title, management/ownership of the Vinayagar Temple and adjoining properties of Arulmigu Subramania Swamy Temple, 3rd Respondent had called both the Petitioner as well as said Purushothaman for enquiry. While the said Purushothaman had appeared for enquiry before the 3rd Respondent, Petitioner has filed this Writ Petition on the premise that 3rd Respondent being the Revenue Authority has no jurisdiction either to conduct any enquiry or to decide the title and ownership over the temple properties.

The learned counsel for the Petitioner submitted that the Petitioner has not appeared for enquiry before the 3rd Respondent only in view of the apprehension that if impugned enquiry proceedings continue, 3rd Respondent may proceed to decide the title of subject properties, which is beyond the jurisdiction of 3rd Respondent.

4. The learned Government Advocate for the Respondents clarified and submitted that the aforesaid enquiry was only intended to ensure that the law and order is maintained and the same was not intended to decide title over the subject properties.

Considering the above submissions made by the learned counsel on either side, this Court directs the Petitioner to appear for enquiry before the 3rd Respondent on 01.07.2026 at 11.00 a.m. It is open to the Respondent Authorities to issue notice to Mr.Purushothaman and any other interested parties, calling upon them to participate in the enquiry scheduled to be held on 01.07.2026.

6. This Writ Petition is disposed of with the above directions. No costs. Consequently, connected Miscellaneous Petition is closed. 29-06-2026 Index: Yes/No Speaking/Non-speaking order mrr
