Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus directing the first respondent to consider the representation of the petitioner dated 11.07.2023 to expedite the trial cases of the detenue Jagadesh, S/o. Ranjith Singh RT No.1874, now confined in Central Prison, Puzhal-1, Chennai-66 to secure the ends of justice.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ of Mandamus has been instituted to direct the first respondent to consider the representation of the petitioner dated 11.07.2023 to expedite the trial cases of the detenue Mr.Jagadesh, S/o. Ranjith Singh, RT No.1874, now confined in Central Prison, Puzhal-I, Chennai.

2. The very relief sought for in the present writ petition to direct the first respondent to direct the Director General of Police to consolidate the cases cannot be granted by this Court in exercise of the powers of Judicial review under Article 226 of the Constitution of India. It is beyond the jurisdiction of the District General of Police to comply with the direction if at all issued as sought for by the petitioner in the present writ petition.

3. Mr.R.Sankarasubbu, the learned counsel for the petitioner would submit that the detenue is facing several criminal cases in various places. More specifically, in and around Chennai.

4. That being so, the detenue has to make request to the Court concern for expedite the Trial. Contrarily, a writ petition seeking a direction to the Director General of Police is not entertainable. Therefore, the detenue is at liberty to make appropriate request to the jurisdictional Court concerned for the purpose of disposal of the Criminal Cases as expeditiously as possible.
