ORDER

[Order of the court was made by M.JAICHANDREN, J.,] This Habeas Corpus Petition, has been filed by the petitioner herein, who is the mother of the detenue, praying that this Court may be pleased to direct the respondents to produce her daughter, Nithya, aged about 20 years, who is said to be in the illegal custody of the respondents 2 to 4 herein, before this Court and to set her at liberty.

Heard the learned counsel, appearing on behalf of the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the 1st respondent.

The petitioner had stated that her daughter, namely, Nithya, aged about 20 years, had completed D.T.Ed. Course and she has been missing from 21.02.2016 and that, she had been taken away by the respondents 2 to 4, along with 20 sovereigns of gold and Rs.30,000/- in cash. Therefore, the petitioner had lodged a complaint before the 1st respondent police on 25.03.2016 and the said complaint has been registered as a case in Cr.No.51/2016 on the same day, as a "woman missing" case. As the 1st respondent had not taken effective steps to trace the detenue, the petitioner is before this Court with this petition.

Today, when the matter had been listed for admission, the learned Additional Public Prosecutor, appearing on behalf of the 1st respondent, has stated that the detenue, Nithya, had eloped with the 2nd respondent herein and had got married, on 08.03.2016. The said marriage had also been registered before the Sub Registrar, Thirukuvalai, in Nagapattinam District. He had also produced a copy of the Certificate of Registration of Marriage dated 08.03.2016 before this Court.
