The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(B), 194(B), 323, 154, 376, 498(A) and 506(2) of IPC and Section 4 of the Woman Harassment Act in Crime No.10 of 2022, seek anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that the first petitioner had in a drunken mood daily and tortured the victim and also compelled to have physical relationship. The second petitioner, who is the father-in-law of the defacto complainant, had also sexual torture to the victim. The third petitioner supported to both the 1st and 2nd petitioners. Hence, the complaint.

4. A perusal of the FIR reveals that there are totally three accused, in which the petitioners are arrayed as A1 to A3. The first petitioner is husband of the victim. She is physically handicapped. They got married on 12.06.2020. The first petitioner had consumed alcohol daily and tortured the victim and also compelled to have physical 1/3

relationship even on her illness. The second petitioner, who is the fatherin-law of the victim, also attempted to commit rape on her on several occasions utilising her disability and also her poverty. When it was informed to the third petitioner, she also along with other petitioners compelled the defacto complainant to have physical relationship with them. Therefore, all the petitioners had harassed and tortured the victim to the core and also having sexual torture.

5. Considering the above facts and circumstances of the case, the petitioners had committed a very serious and heinous offence as against the victim and as custodial interrogation of the petitioners is very much required, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. 22.09.2022 Lpp 2/3
