Mr.C.Jayaprakash, learned Government Advocate takes notice on behalf of the first respondent. Mr.U.Bharanidharan, learned Standing Counsel takes notice on behalf of the second respondent. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to issue re-employment order for the petitioner in the cadre of Professor at Anna University, Guindy Campus till the end of the academic year viz, 31.05.2026 as per guidelines issued in G.O.(Ms) No.192, Higher Education (F1) Department dated 12.11.2024 and G.O.(Ms) No.216, Higher Education (I1) Department dated 29.11.2024.
3.The learned counsel appearing for the petitioner would submit that the petitioner is due to retire on 30.06.2025. Therefore, by virtue 2/5
of G.O.(Ms) No.192, Higher Education (F1) Department dated 12.11.2024 and G.O.(Ms) No.216, Higher Education (I1) Department dated 29.11.2024, the petitioner is entitled for re-employment. In this regard, the petitioner has sent representation dated 19.05.2025 to the second respondent and the same is yet to be considered. 4.Per contra, the learned Standing Counsel appearing for the second respondent would vehemently contend that the very Government Orders will not confer any vested right upon the petitioner and that the said G.Os. were issued only in the interest of the students. In the case on hand, the academic year commences only on 09.07.2025.
5.However, the fact remains that the petitioner has sent representation on 19.05.2025 to the second respondent and the said representation is yet to be considered by the respondents. 6.At this juncture, the learned Government Advocate appearing for the first respondent as well as the learned Standing Counsel appearing for the second respondent would submit that they would consider the above representation within a reasonable time frame. 3/5
7.In such view of the matter, this Court directs the second respondent to consider the petitioner's representation dated 19.05.2025 in line with G.O.(Ms) No.192, Higher Education (F1) Department dated 12.11.2024 and G.O.(Ms) No.216, Higher Education (I1) Department dated 29.11.2024, within a period of ten days from the date of receipt of a copy of this order.
8.The writ petition is disposed of with the above directions. No costs.
