ORDER

This Criminal Original Petition is filed to quash the final report in C.C.No.332 of 2025 on the file of the learned Judicial Magistrate No.II, Poonamallee.

2. Upon considering the submissions made by the learned counsel for the petitioner and the learned Government Advocate (Criminal Side), it can be seen that the quarrel is said to have ensued between the neighbours, pursuant to which the above case has been registered.

3. The submissions made seeking to quash the final report are factual in nature, and it cannot be said that the contentions raised are incontrovertible.

4. In view thereof, all these issues have to be raised during the course of trial and through the cross-examination of the prosecution witnesses. Therefore, keeping open the liberty of the petitioner to raise these grounds during the course of trial, this petition cannot be entertained.

5. Accordingly, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed. 30-06-2026 skr
