ORDER
This writ petition has been filed for the issuance of a Writ of Mandamus directing the respondents to deal with the representation made by the petitioner on 22.10.2024, wherein the petitioner is seeking cancellation of the sale deeds that were executed in the year 2000 in favour of Adi Dravida Welfare Department.
2. Heard Mr.G.V.Sridharan, learned counsel for the petitioner and Mr.E.Veda Bagath Singh, learned Special Government Pleader for the respondents.
3. In the considered view of this Court, the writ petition itself is misconceived. The father of the petitioner had already dealt with the property and sale deed has been executed as early as in the year 2000. If the petitioner has any right over the property and if according to the petitioner, the petitioner's father did not have any right to convey the property, the petitioner must agitate the same before a Civil Court seeking for cancellation of sale deeds that have already been executed by the petitioner's father in favour of Adi Dravidar Welfare Department. The petitioner cannot make a representation to the respondents and seek for cancellation of those sale deeds. This is in view of the fact that once the sale deed is executed and the title has already passed on to the Department, 2/4
there is no question of cancellation of the sale deeds and the only option is either to reconvey the property or question the same before the competent Civil Court. Hence, no useful purpose will be served in directing the respondents to deal with the representation submitted by the petitioner. Except giving this clarity, no further orders are necessary in this writ petition.
