O R D E R
The petitioner is the wife. She married the respondent on 30.03.2018 at Pondicherry. Due to disputes and differences, the parties have separated. The husband has initiated a proceeding for divorce in MOP No.302 of 2024 before the Family Court at Puducherry. The wife pleads that she is taking care of the son, who was born to the couple on 25.01.2019 and he is studying at Velacherry in Chennai.
2. Mr.Vignesh Imaiyavaramban, learned counsel appearing for the husband would submit that the allegations made in the transfer petition are all false. He states that though he is working for Amazon in Chennai, he is now working from home at Puducherry. The learned counsel pleads that the wife is also working at Chennai with Ashok Leyland.
3. Taking into consideration the interest of the wife, despite the vehement objection of Mr.Vignesh Imaiyavaramban, I am inclined to consider this transfer. Accordingly, MOP No.3 of 2024 is withdrawn from the file of the Family Court at Puducherry and transferred to the file of the Sub Court at 2/4
Tambaram.
4. The learned Subordinate Judge, Tambaram, will not insist on the appearance of both the parties as they are employed. They shall, however, appear when their appearance is essential or when so directed by the Sub Court, Tambaram. On the other hearings, they may be represented through the counsel.
5. In the result, the Transfer Civil Miscellaneous Petition stands allowed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
