Vasanthi ..Respondents Prayer: This Civil Miscellaneous Petition is filed under Section 173(1) of Motor Vehicles Act, 1988, to condone the delay of 700 days in filing the above appeal against the order dated 20.12.2022 made in M.C.O.P.No.51 of 2018 on the file of the Motor Accidents Claims Tribunal, Principal Sub Judge, Mayiladuthurai.

ORDER

This petition has been filed seeking to condone the delay of 700 days in filing the appeal.

2. Heard the learned counsel for the petitioners.

3. Mr.B.Jawahar, learned counsel for the 1st respondent has raised objections in allowing the petition.

4. The petitioners would aver that after obtaining the certified copy of the award, it was forwarded to the divisional office and thereafter to the regional office at Madurai. Hence, the delay of 700 days occurred in filing the Civil Miscellaneous Appeal.

5. Accepting the reasons stated in the affidavit, this Civil Miscellaneous Petition shall stands allowed on payment of costs of Rs.1,000/- payable in favour of the Tamil Nadu State Legal Services Authority, Chennai on or before 26.09.2025. Failing which, this petition shall stand automatically dismissed without any further reference to this Court.
