This petition filed to relax the condition imposed on the petitioner to appear before the respondent police daily at 10.30a.m. until further orders in Crl.A.No.791 of 2024 dated 03.07.2024.

This Court, by order dated 03.07.2024 granted bail to the petitioner directing petitioner to appear before the respondent police daily at 10.30a.m. until further orders.

The learned counsel for petitioner submitted that the petitioner is working as Bank Manager. The Defacto complainant his neighbour. Petitioner and the defacto complainant had a love affair and it is now alleged that the petitioner committed rape. Due to the conditions imposed, he is put to great difficulty, unable to continue with his work. Further he submitted that the petitioner regularly appearing before the respondent police without default.

The learned Government Advocate submitted that the petitioner complying with the conditions imposed by this Court diligently. Further he submitted that in this case investigation almost completed and charge sheet to be filed soon.

The third respondent/de-facto complainant, served with the notice, a counsel is present before this Court and submitted that the petitioner is not cooperating with the trial.
