This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 23.06.2024, seeking bail in Crime No.361 of 2024 registered for the offence under Sections 279, 308, 304(ii) of IPC (2 counts) and Section 188 of Motor Vehicles Act.

2. Learned Counsel for the petitioner submitted that the petitioner is an innocent person, and he has been falsely implicated in this case. He further submitted that the petitioner, who has not committed any offence, as alleged by the prosecution, has been in custody from 23.06.2024. Hence, he sought for bail stating that, the petitioner is ready to abide by any conditions that may be imposed by this Court.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that, the accused persons and the son of the de facto complainant had illegally conducted the auto race and also caused a threat to the safety of the public and vehicles on the road. 4. He further submitted that more than 20 persons were implicated as an accused in this case and some of them are still absconding and the petitioner is arrayed as A8, who was also one of the coordinators and video graphed the race. He also submitted that the investigation in this case is at initial stage.

5. Considering the facts and circumstances of the case, and the submissions made by the learned counsel on either side and also considering the nature and gravity of the offence committed by the accused and taking note of the fact that the investigation is at initial stage, this Court is not inclined to grant bail to the petitioner.
