The petitioner herein seeks protection from the harassment by the respondent police under the guise of enquiry in Cr.No.151 of 2024 1/4

registered for the offence under Section 174 of Cr.P.C in connection with the suspicious death of Heramba Ganesh.

2. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the respondent police during the course of investigation, found that this petitioner and the deceased Heramba Ganesh were friends and before the death of Heramba Ganesh, he had contacted the petitioner herein, for that purpose, petitioner had been called for enquiry. Instead of participating in the enquiry, the petitioner has come before this Court as if the police is harassing him.

3. Taking into consideration the facts and circumstances of the case, this Court finds that for the investigation, the presence of the petitioner is required and he is duty bound to disclose all the informations which he has in his possession and knowledge to the police in connection with the Heramba Ganesh who has died in a suspicious circumstances. Therefore, this Court finds no merits in this petition. Hence, this Criminal Original Petition is dismissed. However, the petitioner shall appear before the respondent police on receipt of summon. 12.08.2024 Vv To 2/4
