Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus Directing the 4th and 5th Respondents to consider and to pass appropriate orders based on petitioner representation dated 06.04.2026 requesting to survey and to bifurcate the common pathway measuring to a width of 20 feet in property comprised in Survey Nos.89/3B, 89/3B1B, 89/ 3B1A, 89/3A1 and 89/3A2 situate at Paruvadhanahalli Revenue Village, Pennagaram Post and Taluk, Dharmapuri District based on the Settlement deed dated 12.09.2012 registered as Document No.3248/ / 2012 and by cancelling the Patta No.8294 issued in name of 7th Respondent. ORDER

This Writ Petition has been filed to direct the respondent to consider the petitioner's representation dated 06.04.2026.

2. Learned counsel for the petitioner would submit that the petitioner has made a representation dated 06.04.2026 to conduct survey and to bifurcate the common pathway measuring to a width of 20 feet in property comprised in Survey Nos.89/3B, 89/3B1B, 89/ 3B1A, 89/3A1 and 89/3A2 situate at Paruvadhanahalli Revenue Village, Pennagaram Post and Taluk, Dharmapuri District based on the Settlement deed dated 12.09.2012 registered as Document

No.3248/ / 2012 and by cancelling the Patta No.8294 issued in favour of 7th Respondent. However, the same was not considered, as on date. Hence, this writ petition.

3. Mr.B.Pachaiyappan, learned Government's Counsel accepts notice on behalf of the respondents 1 to 6 and submitted that the petitioner's representation dated 06.04.2026 will be considered within a period of twelve weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondents 3 & 4 to consider the petitioner's representation dated 06.04.2026 and carry out a survey and complete the process, after giving prior notice to the petitioner as well as respondents 7 & 8 and other aggrieved parties, if any, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent to conduct a survey and lay boundary

stones at the subject land. In the event any dispute arises regarding the possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court.

7. With the above direction, this writ petition stands disposed of. No costs.
