This appeal is filed under Section 96 read with Order XVI Rule 1 of the Code of Civil Procedure, to set aside the judgement and decree dated 17.12.2018 and made in O.S.No.33 of 2018 on the file of the III Additional District and Sessions Judge, Tiruppur at Dharapuram. J U D G E M E N T (Judgment of the Court was delivered by R.SUBRAMANIAN, J.) Pending the Appeal the parties have settled the dispute and entered into a Joint Memorandum of Compromise providing for a resolution of the entire dispute between them. A Joint Memorandum of Compromise dated 15.09.2023, signed by the parties as well as the counsel is filed. The appellant as well as respondents 2 and 3 have agreed to take the property in equal moieties. The parties would affirm the terms of the compromise.

2. In view of the same, the compromise is recorded the Appeal will stand disposed of in terms of the Joint Memorandum of Compromise. The Joint Memorandum of Compromise shall form part of the decree. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
