The petitioner, who was arrested and remanded to judicial custody on 09.06.2022 for the offences punishable under Section 506(ii) of IPC and Sections 5(l) read with 6(1) of POCSO Act, 2012 in Crime No.14 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on the pretext of love affair, the petitioner had committed penetrative sexual assault on the victim girl aged about 16 years. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that now investigation is completed and final report is filed. That apart, the petitioner had love affair with the victim girl and as such, he seeks for grant of bail to the petitioner.

4. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that on the pretext of love affair, the petitioner compelled

the victim girl and had penetrative sexual assault on the minor victim girl. Again, on another occassion also, he compelled her to have sexual intercourse and had threatened her that he will disclose the earlier sexual assault.

5. Therefore, the petitioner has committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
