This petition is filed to condone the delay of 391 days in filing the appeal.

Heard Mr.C.Paraneedharan, learned counsel for the petitioners, who has made an endorsement in the Court bundle stating that the petitioners want to give up the second respondent, as he is not the main contesting respondent, against whom, no relief is sought in the appeal.

Recording the same, the second respondent is removed from the array of parties in the appeal.

Mr.J.Michael Visuvasam, learned counsel appears for respondent 3 Insurance Company and submits that he has no objections in allowing this petition to condone the delay, provided, the petitioner shall not claim interest during the delay period.

Respondents 1 and 4, though served and the names and addresses having been shown in the cause-list, none appears.

Recording all these aspects, we are inclined to allow this petition and the delay of 391 days in filing the appeal is condoned with a condition that the petitioner/appellant shall not claim interest during the delay period.
