ORDER

The contempt petition has been filed for non-compliance of the order passed by this Court in W.P.No.823 of 2022 dated 24.01.2022. 2.The petitioner had earlier filed W.P.No.823 of 2022 seeking for police protection for ingress and egress of vehicles and workers from in and out of the petitioner company premises and further no striking activities or assembling illegally in any form within the radius of 700 meters from the petitioner's company premises to be permitted. This Court, on 24.01.2022, considering the submissions of all concerned had directed the petitioner to lodge a complaint before the first respondent therein/Inspector of Police, Maraimalai Nagar Police Station and thereafter the Inspector of Police, Maraimalai Nagar Police Station to provide police protection to petitioner's factory premises and to ensure that there is free ingress and egress of men, materials and vehicles and any demonstration/strike to be held only beyond 200 meters from the petitioner's factory premises. The petitioner had sent a 2/6

notice to the Commissioner of Police, Deputy Commissioner of Police, Tambaram and to the Inspector of Police, Maraimalai Nagar on 24.05.2025 alleging that on 12.03.2025 some AITUC Union Members indulging in illegal activities and they are threatening the employees and hence there is a violation of the order passed in W.P.No.823 of 2022. Hence, the above contempt petition.

3.Today, Mr.A.Govindaraj, Inspector of Police, T-9, Maraimalai Nagar Police Station, Maraimalai Nagar, Chengalpattu District is present before this Court.

4.The learned Additional Public Prosecutor submitted that there was some unrest in the factory premises, among the employees, some are supporting the Management and some against the Management. It is an internal matter. Based on the complaint, the Inspector of Police, Maraimalai Nagar Police Station assigned CSR No.97 of 2020 and all concerned called for enquiry. The Deputy Commissioner of Labour-I, Sriperumbudur in 3/6

Na.Ka.No.A/06/2021 dated 29.01.2021 had declared that no strike to be held and if any strike or protest is held, it would be considered as illegal. Following the same, the petitioner had filed a writ petition before this Court in W.P.No.823 of 2022 and this Court directed protection to the petitioner's company, thereafter the factory functioning smoothly. This being so, on 12.03.2025, again some factory workers engaged in unlawful strike activities, viz., Assembling in large numbers within the factory premises without authorisation, Sleeping inside the premises and obstructing normal operations, Threatening and preventing employees, who were attending the work. Hence, the production operations of the factory greatly affected. This protest by the employees is within the factory premises and the order passed in W.P.No.

823 of 2022 is with regard to ensuring free ingress and egress of men, material and vehicle and to have protest 200 meters away from the factory. What had happened inside the factory is an internal matter and it is for the Management to deal with it and now a complaint has been received.

Management, all called and it was agreed between them that they would seek remedy through the Labour Commissioner and gave a written undertaking. Now inside the factory there is no obstructions and production activities functioning smoothly. In this case, the directions given by this Court in W.P.No.823 of 2022 had been complied with and there is no violation of the order. What had happened on 12.03.2025 and days thereafter are subsequent developments and it is now resolved.
