Respondents Prayer: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to withdraw the case in Crime Number 120 of 2019 pending on the file of the 3rd respondent and entrust the same to the 4th respondent for fair investigation and to file the final report within a time frame fixed by this Court.

The 3rd respondent has initiated enquiry under Section 174 Cr.P.C. It would not be appropriate to consider the petitioner's request to incorporate the offences under Section 302 of IPC, https://hcservices.ecourts.gov.in/hcservices/

which would be a subject matter for consideration after the enquiry under Section 174 of Cr.P.C. has been completed. 2.Nevertheless, if the 2nd respondent is directed to monitor the enquiry conducted by the 3rd respondent, the ends of justice would be secured.

3.In the light of the above observation, there shall be a direction to the 3rd respondent herein to complete the enquiry under Section 174 of Cr.P.C. in Crime No.120 of 2019, as expeditiously as possible and such an enquiry shall be monitored by the 2nd respondent herein on day-to-day basis. 4.Accordingly, the criminal original petition is disposed of.
