Comp. A.No.410 of 2023 in C.P.No.245 of 2013 ABDUL QUDDHOSE.J., This application has been filed to condone the delay of 919 days in filing the claim petition before the respondent.
2. The applicant claims to be a Labour Union Secretary of Employees of M/s.Aadhavan Processor Private Limited, the Company under liquidation. The applicant claims that he is representing the interest of 64 workers of M/s.Aadhavan Processor Private Limited, the Company under liquidation. The applicant has stated in the affidavit that only on account of Covid-19 Lockdown, there has been a delay in lodging a claim on behalf of the 64 workers with the respondent.
3. The learned Official Liquidator appearing for the respondent has also not raised any serious objection for allowing this application, seeking to condone the delay of 919 days in filing the claim Petition. 1/3
4. This Court is satisfied with the reasons stated in the affidavit filed in support of this application. Accordingly, this application is allowed as prayed for.
5. The learned Official Liquidator is directed to receive the claim filed by the applicant, if the same is filed within a period of one week from the date of receipt of a copy of this order and adjudicate the same in accordance with law.
