Crl.O.P.No.23956 of 2016 R.MALA,J.
The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 448 and 506(ii) of the Indian Penal Code, in Crime No.851 of 2016, on the file of the respondent police and hence, pray for anticipatory bail.
2. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays for anticipatory bail.
3. The learned Government Advocate (Crl.side) would submit that due to wordy quarrel, the petitioners have abused the defacto complainant. He would further submit that no one is injured in this case. However, he prays for dismissal of the application.
4. It is seen from the records that anticipatory bail was already granted to the petitioners, vide order dated 05.07.2016, but the petitioners are not able to surrender and hence, they came forward with this petition.
5. Considering the rival submissions made by both sides and also considering the fact that no one has injured in the case, and even though the petitioners were not arrested, neither they interfered with the investigation nor absconded from the jurisdiction and that they have not involved in any other previous case, I am inclined to grant anticipatory bail the petitioners, with certain conditions.
