Respondents PRAYER: The writ petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the records of the impugned order of the 4th respondent in his proceedings in f/vz;: c br bgh/,&g/M/tpsf;F/nfh.Court case/t/vz;/ dated 12.11.2021 and quash the same and consequently, direct the respondents to provide electricity connection to the petitioner's tenated premises, viz., Old No.199, New No.267, 1st Floor, No.3, Thousand Lights, Anna Salai, Chennai-600 002. ORDER

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner's application for an electricity connection has been rejected vide the impugned proceedings of the third respondent on two grounds: (a) Inasmuch as the site on which the petitioner's building is situated, belongs to Waqf, the petitioner is required to obtain a NOC from the concerned Mutawalli; (b) There was some arrears due on the previous service connection in the property, and this amount has not been settled yet.

3.Learned counsel for the petitioner submitted that he could obtain the NOC from the Mutawalli, but he needs to be informed about the amount due and payable by the erstwhile tenant of the building.

4.In view of the above, this Court directs the fourth respondent to issue the petitioner with the requisite information / notice about the arrears of electricity charges referred to in the impugned proceedings within a period of two (2) weeks from the date of receipt of an online copy or the date on which the order is hosted in the official website, whichever is earlier. Subject to the petitioner complying with the requirements indicated in the impugned order, the 4th respondent is required to dispose of the same within a period of four (4) weeks from the date on which the requirements are complied.

6.This writ petition stands disposed of accordingly with the above directions. No costs. Consequently, the connected miscellaneous petition is closed. 04.08.2023 Anu Index : Yes / No 3/4
