This writ petition has been filed for the issue of writ of mandamus directing the 1st respondent to consider the representation dated 29.03.2022 and to include the name of the petitioner in the panel for the post of Grade-I Warder for the year 2011-2012 on par with the junior of the petitioner and to grant all consequential promotions with all service and monetary benefits.
2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. 3.In the considered view of this Court, the relief as sought for by the petitioner has to be rejected on the ground of latches. In the instant case, the petitioner wants his name to be included in the panel of Grade-I Warder for the year 2011-2012. The petitioner has admittedly retired from service in the year 2013. It is seen from the records that the petitioner after his retirement has made two representations only in the year 2019 and 2022. Thus, the petitioner has not taken any effective steps 2/4
to work out his remedy at the earliest point of time. In service jurisprudence, delay has a lot of impact on the relief that is sought for by an employee. The petitioner wants his name to be included for the panel year 2011-2012 and he has knocked the doors of the Court at the evening of his life when he is 69 years. This Court is not inclined to entertain this Writ Petition.
4.In the light of the above discussion, the relief sought for by the petitioner cannot be granted by this Court. Accordingly, this Writ Petition stands dismissed. No costs.
