T.V.THAMILSELVI, J., The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 328 of IPC r/w.Section 6, 20(1) of Cigarette and other Tobacco Acts, 2003 and Under Section 4(1) (a) of TN Prohibition Act in Crime No.474 of 2023, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 10.12.2023 the respondent police while on patrol surveillance, the respondent police chased cars bearing registration numbers TN 64 L 0759, GJ 35 B 1317, MH 04 KD 4301, KL 22 N 5460 and MH -2 EP 3657 and the respondent police found in possession of banned tobacco products and liquor from the said cars. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has given his vehicle to his friend and he is not aware of anything as alleged in the complaint. This petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent raised objection stating that in this case huge amount of contraband were involved. The total amount of tobacco and liquor product involved in this case is 1841.260Kg worth about Rs.12,44,440/- Hence, he raised strong objection to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioners and also the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

6. Considering the facts and circumstances of the case and the submissions made by the counsels and on considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 01.08.2024 gvn
