2. This order will dispose of the captioned application which has been taken out by sole plaintiff with a prayer to set aside the abatement caused owing to demise of third defendant (Mrs.Parvathaneni Shalini Kumar).

3. Mr.K.Sai Sharavan Kumar, learned counsel on record for sole plaintiff is before this Commercial Division.

4. Adverting to support affidavit, learned counsel submits that delay was owing to time taken for furnishing of Death Certificate and Legal heirs Certificate by the counsel on the other side. However, it is not necessary to delve into this aspect as Mr.K.C.Ramamurthy, learned counsel for second defendant very fairly submits that he is not opposing the captioned application and prayer can be acceded to.
