2. Captioned application has been filed with a innocuous prayer to condone the delay of 40 days in representing the application qua D.No.60475 of 2022.

3. Learned counsel for applicant / plaintiff, adverting to support affidavit more particularly, paragraph No.3 submits that the delay is due to administrative difficulties and therefore the delay is neither wanton nor willful.

4. Learned counsel for contesting defendants very fairly submits that he is not opposing the prayer owing to the reason given and innocuous nature of prayer.

5. Considering the facts and circumstances of the case, this Court is inclined to accede to the prayer in captioned application.
