ORDER

Heard learned counsel for the petitioner and learned Govt. Advocate appearing for the respondents.

2. The petitioner, by the present writ petition has assailed the action of the respondents in transferring him from the Office of District Education Office, South to District Education Office, West.

3. Though on behalf of the petitioner, it is contended that the respondents

while effecting transfer, did not follow the rules and also the petitioner having not completed three years of service in the said place i.e., in the office of District Education Office, South, it is to be noted that transfer is an incidence of service and since, the petitioner has been transferred on administrative grounds from the office of District Education Office South to District Education Office, West, within the same City, this court is of the view that mere change of Office from one location to another location would not and cannot be considered as affecting the rights of the petitioner for him to claim the respondent having not followed the procedure laid down.

4. Accordingly, this Court is of the view that no case is made out for interference by this Court. Therefore, the writ petition is devoid of merits and the same is hereby dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
