ORDER

The prayer in this Criminal Original Petition is filed to quash the proceedings in C.C.No.151 of 2026 pending on the file of the District Munsifcum-Judicial Magistrate, Thirukazhukundram, which is taken on file for the offence under Sections 126(2), 191(2), 191(3), 296(b), 115(2), 118(1), 351(3), 351(2) BNS.

2. Considering the fact that the entire occurrence is said to have arisen out of a marital discord and the parties have ironed out their differences and are living together.

3. In view of the dictum law laid down by the Hon'ble Supreme Court in the case of B.S.Joshi & Ors. Vs State of Haryana & Anr.1, this is a fit case to exercise the extraordinary jurisdiction under Section 528 of BNSS to quash the proceedings.

In view thereof, this Criminal Original Petition is allowed and the final report and all further proceedings in C.C.No.151 of 2026 on the file of the District Munsif-cum-Judicial Magistrate, Thirukazhukundram is quashed. 30-06-2026 sp To 1.The District Munsif-cum-Judicial Magistrate, Thirukazhukundram.
